These Terms cover use of the Kasheer POS software, related websites, tenant subdomains, and optional add-on services (online ordering, WhatsApp tools, delivery channels, payments, AI features, and similar). By creating an account, starting a trial, or paying for a plan, you agree to them.
“You” means the restaurant or business that owns the account. “We” means the Kasheer POS platform operator.
1. The service
Kasheer POS is a hosted restaurant system. Depending on your plan, it may include point of sale, kitchen display, inventory, online ordering, QR self-order, reservations, reporting, accounting tools, SMS or WhatsApp messaging, mobile app access, delivery-channel integrations (for example Deliverect), card terminals (for example NamiPay), online checkout (for example MyFatoorah), and AI helpers such as Ask AI or AI Food Menu.
Features shown on marketing pages are available only if they are included in your active plan and correctly configured for your account. Quotas (users, outlets, invoices, AI credits, and similar) follow the limits on that plan.
2. Accounts and access
- You must give accurate business and contact details when you register.
- You are responsible for users you invite, their passwords or PINs, and activity under your company account.
- Each paid subscription is for your business. You may not resell the platform as a competing hosted service without a written agreement.
- Tenant sites (subdomain or custom domain) remain part of the Kasheer service. DNS and SSL for custom domains may take time to verify; that delay does not cancel your subscription fees once billing has started.
3. Plans, trials, and billing
- Paid plans renew according to the interval you choose (for example monthly or yearly), unless cancelled under the rules of your plan.
- Free trials may require a valid card. Card verification is not a charge for the trial itself. If the trial converts to a paid plan, billing starts when the trial ends, using the saved payment method unless you cancel in time.
- Payments are processed by third-party providers (such as MyFatoorah). Their terms and security practices also apply to the payment step.
- Prices, plan names, and included features can change. Changes for existing customers are applied according to your current agreement or with notice where required.
- Failed payments, unpaid invoices, or expired access windows may lead to suspension of the account until the balance is cleared.
4. Your data
Sales, menus, inventory, customers, and other operational data you enter remain yours. We host and process that data to run the product, provide support, improve reliability, and meet legal obligations.
You must only upload or process data you have the right to use (including customer phone numbers for SMS or WhatsApp). You are responsible for privacy notices to your end customers where local law requires them.
We may keep backups and logs for a reasonable period. After an account is closed, data may be deleted or anonymised after any retention window we publish or that law requires.
5. Messaging, channels, and third-party tools
Optional connections (Meta WhatsApp, SMS gateways, Deliverect, NamiPay, payment gateways, AI providers, and similar) are subject to those providers’ rules and fees. We are not responsible for outages, policy changes, message delivery failures, or charges billed by those providers to you.
You must not use messaging features for spam, fraud, or content that breaks applicable telecom or platform rules.
6. AI features and credits
AI tools (including Ask AI, menu generation, insights, or image helpers) consume plan allotments and/or purchased credits. Credit use is recorded against your company wallet. Estimates shown in the product are guides only; actual usage can vary.
AI output can be wrong or incomplete. You must review menus, prices, accounting suggestions, and other AI results before you rely on them in production.
7. Acceptable use
Do not attempt to break into the service, probe other tenants’ data, overload the platform, reverse-engineer protected parts of the software, or use the system for unlawful activity. We may suspend access if we reasonably believe an account is being abused or puts the platform at risk.
8. Availability and support
We aim to keep the service available, but we do not guarantee uninterrupted uptime. Maintenance, third-party failures, and events outside our control can cause downtime. Support is provided through the channels we publish (for example email or phone).
9. Intellectual property
Kasheer POS software, branding, and documentation belong to us or our licensors. Your menus, logos, and restaurant content remain yours. You grant us a limited licence to host and display that content as needed to operate your account and customer-facing pages you enable.
10. Liability
The service is provided on an “as available” basis. To the extent allowed by law, we are not liable for lost profits, lost sales, inventory discrepancies, failed deliveries, tax/ZATCA filing outcomes, or indirect damages. Our total liability for a claim relating to the service is limited to the subscription fees you paid to us for the three months before the claim.
Nothing in these Terms excludes liability that cannot be limited under applicable law.
11. Cancellation and termination
You may stop using the service and cancel renewal where your plan allows. Fees already charged for a billing period are generally non-refundable unless we say otherwise in writing or local law requires a refund.
We may end or suspend an account for material breach of these Terms, non-payment, or legal risk, with notice when practical.
12. Changes
We may update these Terms from time to time. The effective date at the top will change when we do. Continued use after an update means you accept the revised Terms, except where law requires a different process.
